1. Applicability

The business relationship between Julia Thurau | FEN MUSIC, Steglitzer Damm 57B, 12169 Berlin (hereinafter referred to as FEN, “we”) and the customer (hereinafter referred to as “customer,” “you”) is governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.
A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor related to their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Offers, service descriptions

The presentation of products or services in our online shop does not constitute a legally binding offer, but rather an invitation to place an order. Service descriptions on our website do not constitute a promise or guarantee. All offers are valid “while stocks last,” unless otherwise stated. Furthermore, errors excepted.

3. Order process, conclusion of the contract

As a customer, you can select products or services from our range without obligation and order them by email or via the shopping cart of our service partner “Reservix.” In the case of a booking via partners such as the ticket provider “Reservix,” their terms and conditions apply.
Workshops and master classes can usually also be booked by email. We prefer this method in order to ensure the best possible advice. After your non-binding inquiry, you will receive a confirmation of your booking and a request to provide your billing address. Your order becomes binding once you have provided your billing address. FEN will send you an invoice with a request for payment in good time before the course begins. The purchase is complete upon payment of the invoice. FEN reserves the right to reject offers from the customer without giving reasons.

4. Prices

All prices stated on our website include the applicable statutory sales tax, if the services require this.

When completing the order process, you can choose from the available payment methods. If payment by invoice is possible, payment must be made within 30 days of receipt of the goods and the invoice. Payment should be made to the following account:

For all other payment methods, payment must be made in advance without deduction. If third-party providers are commissioned to process payments, e.g. PayPal, their general terms and conditions apply.

5. Cancellation policy

Right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you completed the purchase with payment. To exercise your right of cancellation, you must inform us

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of cancellation
If you withdraw from this contract, we shall reimburse you for all payments we have received from you without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts: Contracts for the delivery of audio or video recordings or computer software in sealed packaging, if the seal has been removed after delivery.

6. Goodwill for workshops and master classes

Cancellation and changes
FEN reserves the right to cancel a workshop if there are fewer than five participants. If a workshop has to be canceled due to insufficient numbers of participants or force majeure (e.g., illness of the instructor), FEN will offer either an alternative date or a refund of the participation fee in good time (workshop: no later than 3 days before the start). FEN also reserves the right to make changes to the workshop program, provided that the fundamental character of the event is retained. Changes of lecturers, minor changes to the event schedule, or a reasonable change of venue do not entitle you to a price reduction or withdrawal from the contract. FEN is not liable for any wasted expenses or other disadvantages incurred by you as a result of the cancellation (except in cases of intent and gross negligence).

Withdrawal by you (contractual partner)
Cancellation of a workshop that has already been booked must be declared in writing and is free of charge if it is made at least 30 days before the start of the event. In the event of later cancellation, half of the participation fee will be due.

7. Closing remarks

The language of the contract is German. European Commission consumer platform for Online Dispute Resolution (ODR): http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings in front of a consumer arbitration board.
